Terms of service
Last updated 27 October 2026
These terms apply when you subscribe to a Chocom plan. Chocom ("we", "us") designs, hosts and looks after websites for local businesses. "You" means the business that subscribes. By ticking the box at checkout you accept these terms. If something here is unclear, write to hello@chocom.app before you subscribe.
1. The free design
Before you pay anything, we can design a first version of your new website and send you a private link. It is free and you have no obligation to subscribe. If you don't subscribe, we take the design down.
2. The plans
Essential includes your new website designed for you, hosting, security and backups, call, booking and map buttons, your domain connected to it, and one change request a month (one message with as many small changes as you like).
Max includes everything in Essential, plus unlimited change requests handled one at a time, usually within 24 to 48 hours; local SEO worked on every month; your Google Business Profile managed; replies to your Google reviews written in your voice; a new logo designed for you; and a monthly report.
Studio projects (several locations, online shops, bigger builds) are quoted separately, and the quote describes what is included.
A "small change" is an update to existing content: words, prices, hours, photos, a new section built from what is already on the site. A new page or a redesign of the site is a bigger job: we tell you before starting if it falls outside your plan.
3. What we need from you
You give us accurate information about your business and only send us content (text, photos, logos) that you have the right to use. You remain responsible for what your website says about your business, your prices and your services. We may refuse to publish content that is unlawful or misleading.
4. Price and billing
The price of your plan is shown at checkout, in your currency, and stays the same for as long as your subscription stays active. You pay monthly or yearly, in advance, by card through our payment provider, Stripe. Your subscription renews automatically at the end of each period until you cancel. There is no setup fee. Taxes are added where the law requires.
If a payment fails, we let you know and try again. If it still fails after 14 days, we may pause your website until the payment goes through.
5. Cancelling
There is no contract length. You can cancel at any time by writing to hello@chocom.app or yourself from your billing page, with the email you paid with.
- Monthly plans: your subscription stops at the end of the month you have paid for. Nothing more is charged.
- Yearly plans: the year you have paid for stays active until its end and is not renewed. Because the yearly price already includes two free months, we don't refund the unused part of a year, except where the law requires it.
There is no exit fee.
6. Who owns what
- Your domain name is yours. We only point it to your website. If you leave, it stays with you.
- Your content (your text, photos, logos and business information) is yours. When you leave, we send you a copy on request.
- The website itself (its design, layout, code and the images we provide) is created and hosted by Chocom and is part of your subscription. You may use it for as long as your subscription is active. When the subscription ends, the website goes offline.
- The logo designed for you on the Max plan becomes yours once you have paid for three months of Max.
7. Our side
We host your website on reliable infrastructure, keep it secure and back it up, and fix problems as quickly as we reasonably can. We don't promise the website will never be unavailable, and we can't guarantee any position in Google or any number of customers: search results depend on things nobody controls. Our work on local SEO, your Google profile and your reviews is done with care, but its results are not guaranteed.
8. Liability
We are responsible for doing the work described here with reasonable care and skill. To the extent the law allows, we are not responsible for indirect losses such as lost profits or lost business, and our total liability for a claim is limited to the amount you paid us in the 12 months before it.
Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law.
9. Ending the service from our side
We may end a subscription if you seriously break these terms, for example by asking us to publish unlawful content, or by not paying. Unless the breach is serious, we warn you first and give you time to fix it. If we ever stop offering a plan, we tell you at least 30 days before and refund any period paid in advance that we won't provide.
10. Changes to these terms
If we change these terms, we tell you by email at least 30 days before the change applies to you. If you don't agree, you can cancel before it does.
11. Contact
